This page contains the terms and conditions for purchase from our online shop. Please read them carefully before ordering products from us. By ordering our products you have agreed to these terms and conditions.
We are in use of persistent cookies and this type of cookie saves a file permanently on your computer and is used to track visitor movements on the website. This cookie s only used to offer visitors better services and support and the text files can be deleted. At THE HAPPY WHALE we use this type of cookie to keep track of your shopping cart and to keep statistics of our visitors. The information stored on your computer is only a unique number without any connection to personal information.
Term of delivery
All products are sold EXW our warehouse in Vaxholm, Sweden, meaning that freight costs from Vaxholm to the destination will be covered by the customer.
All prices in the online shop are including VAT and the choices of currency are Euro (EUR) or Swedish Krona (SEK).
Payments will be made through credit cards.
All products remain the property of THE HAPPY WHALE until full payment is made. The prices applicable are set at the date on which you place your order. Final shipping costs and payment fees are stated in the check out process before confirming the purchase.
All transfers conducted through THE HAPPY WHALE are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled with SSL encryption. Please read the terms and conditions for the payment gateway chosen for the transaction, as they are responsible for the transactions made.
If we have your requested products on stock, your order will be shipped within 3-5 days. If the products cannot be delivered to you within five days, we will send you an email informing you about the actual shipment date.
Shipments to addresses in Sweden will be delivered by DHL. You will be able pick up your order at their pick-up point. A text message will be sent to you when your order is ready to be picked up. International orders will be delivered by UPS.
When shopping, an estimated shipping cost will appear below the generated purchase amount, based on shipping to the country you are in. When checking out the shopping cart, the final shipping cost will be determined after stating your delivery address, and shown in the order summary before confirming the purchase.
Taxes and customs duties
For international shipments any duties, taxes or VAT that might occur will be covered by the customer.
Signing for parcels
When signing for your parcels please make sure you collect the same amount of parcels you sign for. Any lost parcels must be claimed with the forwarder on site.
For parcels that are not picked up within 14 days, THE HAPPY WHALE reserves the right to charge you a handling fee to cover return shipping, freight and administrative costs.
Destroyed packaging / transport damages
If a shipment is lost, or you – when picking up the parcel – notice that the outer box is damaged, you should report that to the pick-up service and save a copy of the report for your reference if something is damaged inside the box. If you notice when opening the box, that an item has been damaged during transport, you should immediately report this to us and if possible include a photo of the damaged goods. Send us an email with this report to firstname.lastname@example.org and mark the email “transport damages”. We will contact you immediately to solve the situation.
Returns must be made no later than 14 days after the day of pick up to generate a full refund of the purchase value. Returned products must be kept in its original packaging, in good condition and unopened. Damaged or opened products will not be accepted and no refunds will be made. Freight costs for returns will be covered by the customer. Please note that refunds are not valid for discounted or customized products. Accepted returns made later than 14 days after the day of pick up can be exchanged for other products.
When returning a purchased product please clearly mark the returning parcel ‘RETURNED GOODS’, to shorten handling time and for international returns avoid any Customs charges. THE HAPPY WHALE will not be responsible for any charges on the returning parcel made by authorities or Customs, they are the responsibility of the customer.
How to return and get a money refund:
1. Before returning your product you need to send an email marked “Return” to email@example.com. State your order number and list the products you would like to return. Once you receive an approval from us you can return the products.
2. When returning the products, clearly mark the parcel with your order number and make sure to note the ID-number of the parcel, and keep the receipt. It’s for your own security and to be able to trace the shipment.
3. For extra security please send the ID-number to us, allowing us to follow the delivery.
4. THE HAPPY WHALE will refund accepted returns immediately. Please allow a few days for the banks to handle the transfer of the funds.
If the product does not correspond to the standard expected please send an email marked “Complaint” to firstname.lastname@example.org stating your order number and describing the nature of the complaint. Please do so as soon as possible after receiving the delivery. We will get back to you immediately to try and solve the problem.
If you wish to change a product for another one; please send an email to email@example.com, state your order number, mark the email “Change product” and let us know which product you would like to return and which one you wish to have instead.
To be able to place an order in our online shop you must be 18 years or older. If you are younger than 18 we will need your parents signature emailed to us.
All products available for purchase are on stock if no other info is shown.
THE HAPPY WHALE will act responsibly for all personal information requested from you. The personal information will be used to ensure deliveries, for credit assessment and to provide offers and information to you. The information you provide is only available to THRE HAPPY WHALE and will not be shared with any third parties. You have the right to inspect the information held about you and you always have the right to request it to be deleted or corrected. By accepting THE HAPPY WHALE´s terms and conditions, you agree to the above.
Events outside THE HAPPY WHALE´s control, which are not reasonably foreseeable, shall be considered force majeure, meaning that THE HAPPY WHALE is released from its obligations to fulfill contractual agreements. Example of such events are, but not limited to; government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.
